ORDER

The present Transfer CMP has been filed by the wife seeking to transfer HMOP.No.37 of 2022 filed by the husband on the file of the Sub Court, Aranthangi for divorce to be transferred to Family Court, Thanjavur.

2. According to the learned counsel for the petitioner the wife is a permanent resident of Thanjavur even as per the address mentioned in HMOP.No.37 of 2022 and she is residing with her parents due to matrimonial dispute.

3. Considering the facts and circumstances this Court is inclined to pass the following order:

(i) HMOP.No.37 of 2022 pending on the file of the Sub Court, Aranthangi, Pudukkottai is withdrawn and transferred to the file of the Principal Sub Court, Thanjavur.

(ii) The learned Principal Subordinate Judge, Thanjavur is directed to transfer the case to the concerned Subordinate Judge, who is dealing with the matrimonial disputes.

4. The Transfer CMP is allowed to the extent as stated above. Consequently, the connected Miscellaneous Petition is closed. 09.02.2023 Index :
