O R D E R

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition has been filed by the father of the detenu seeking to produce the alleged detenu namely Srimathi, D/o.Rengasamy, aged about 21 years, before this Court and set her at liberty.

2. The case of the petitioner is that his daughter Srimathi, aged about 21 years was found missing from 20.06.2024. The petitioner has given a complaint to the second respondent police and a case in Cr.No.205 of 2024 was registered for 'Women Missing'. Since no further action has been taken by the respondent police, the present habeas corpus petition has been filed.

3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents 1 & 2 would submit that based on the complaint given by the petitioner, a case in Cr.No.205 of 2024 was registered for 'Woman Missing'. During the course of investigation, it came to light that the petitioner's daughter had gone along with the third respondent

and the third respondent also found missing. The mother of the third respondent has also given a complaint to the Sammattividu Police Station and the same was also registered in Cr.No.82 of 2024 for 'Man Missing'. Both the Thirugokarnam Police and Sammattividu Police are taking steps to trace the missing person and the third respondent and as and when they are traced or secured it will be intimated to the petitioner and the parents of the third respondent.

4. In view of the above, we find that the detenu is not an illegal detention of anybody. Therefore, this Habeas Corpus Petition is closed with a direction to both the Thirugokarnam Police and Sammattividu Police to continue with the investigation and as and when the missing persons are traced or secured, it shall be informed to the petitioner and the parents of the third respondent.
