ORDER : The Court made the following order :- 1/3
The petitioners / Accused Nos.3,6 and 7, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148 and 302 of IPC in Crime No.145 of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution as found in the FIR is that, on 10.04.2023, at about 9 p.m., the defacto complainant's son Mani and relatives were standing near a high school. Due to previous enmity, the accused persons came there, took up quarrel and caused assault with the brick, hands, wooden log and iron rod. The said Mani sustained grievous injuries and fell on the spot itself. On hearing, the defacto complainant went to the place of occurrence, took him to the hospital. Later the said Mani died. On the basis of the complaint, the case was registered.
3. The learned Additional Public Prosecutor would submit that final report also filed before the concerned Court on 29.01.2023 and has not been processed so far. This is the third application. The investigation has been completed and final report has also been filed and on account of the fact that co-accused has been granted regular bail, this petition has been filed seeking the same relief to the petitioners.
4. Over a simple issue, all the persons joined together and caused severe assault to the deceased. Considering the gravity of the offences and considering the specific 2/3
overt act attributed against the petitioners, this Court is not inclined to grant relief to the petitioners, resorting them either to appear before the committal Court or before the respondent police seeking regular bail.
