Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 2 to 6 to take physical possession of the secured asset bearing Plot No.70 situated in "Lourdusamy Pillai Colony" comprised in Ayan Punja S.F.No.205/1, 205/3, 205/4, 205/5, 205/7, K.Abisekapuram Village, Thiruchirappalli Taluk, Thiruchirappalli District measuring 2,975 square feet and hand over it to the petitioner by implementing the order passed by the first respondent in R.C.G5/15776/2019 dated 28.05.2023 within a time frame fixed by this Court.

Heard both sides.

2.The petitioner had obtained order under Section 14 of the SARFAESI Act from the first respondent on 28.05.2023. The grievance of the petitioner is that till date the third respondent has not implemented 2/4

the same. The third respondent will find out if the order dated 28.05.2023 has been stayed or set aside. If it is not been stayed or set aside within a period of six weeks from the date of receipt of a copy of this order, it is the duty of the fourth respondent to implement the same. 3.Directing the fourth respondent to implement the petition mentioned order passed by the first respondent if the stay is not obtained within the aforesaid time limit, this writ petition is allowed. There shall be no order as to costs.
