Respondent PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the respondent to receive the general power of attorney deed dated 16.08.2019 and register the same presented for registration in respect of the property bearing Survey No.170/A1A, 170/A2A, 308/A1 & 308/A2 situated at Pushpathoor Village, Palani Taluk, Dindigul District.

ORDER

Mr.T.Lenin Kumar, learned Counsel on behalf of writ petitioner and Mr.V.Anand, learned Government Advocate on behalf of sole official respondent are before this Court.

2. Instant writ petition has been filed complaining that the sole respondent refused to receive General Power of Attorney deed dated 16.08.2019 when presented for registration. On such complaint, a Mandamus has been sought qua respondent ie., to direct the respondent to receive the said General Power of Attorney document and register the same.

3. On instructions, learned State Counsel for sole respondent submitted that the said General Power of Attorney document / deed was never presented before the sole respondent.

4. Learned Counsel for writ petitioner is unable to demonstrate that the document was in fact presented for registration before the sole respondent. On the contrary, learned https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.18494 of 2019 Counsel for writ petitioner says that the petitioner will now apply for registration online.

5. If that be the case, instant writ petition is clearly premature. Instant Writ Petition is dismissed. There shall be no order as to costs. However, it is made clear that the dismissal of this writ petition will not preclude the present writ petitioner from presenting the said document online and requesting for registration. If the writ petitioner does so, the same will be examined and carried to its logical end on the basis of the document presented and in accordance with law.
