PRAYER :-.For Bail in Crime No.181 of 2022 on the file of the respondent Police ORDER : The Court made the following order :- The petitioner /Accused No.1, who was arrested and remanded to judicial custody on 11.06.2023 for the offences under sections 457,380 of IPC in Crime No.181 of 2022 on the file of the respondent police seeks bail.

2. The case of the prosecution is that the accused persons trespassed into the house of the defacto complainant and stolen gold ornaments to the tune of Rs.11,00,000/-, hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and is no way connected in this case. The petitioner had lodged a complaint against the defacto complainant only in order to grab the money from the petitioner.

4. The learned Additional Public Prosecutor would submit that out of 52 sovereigns of gold, 18 sovereigns of gold have been recovered and balance has not been recovered. The second accused is still absconding and the petitioner is a habitual offender.

5. Consideration the facts and circumstances of the case and also considering that the petitioner is a habitual offender, if the petitioner is released on bail at this stage, he may tamper the material evidence, which would hamper the investigation, 2/4

this Court is not inclined to grant bail to the petitioner.
