ORDER : The Court made the following order :- 1/4
The petitioners/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 420 of IPC in Crime No.Not Known of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioner is running a Labour workshop for automobiles in the name and style as "Everest Earth moving Labour works". The defacto complainant has given his Hitachi 120 old vehicle chain worth Rs.20,000/- for repair work. The petitioner has stated the defacto complainant that the vehicle chain has damaged and it can be used only for scrap. The petitioner again contacted the defacto complainant for returning of his property, but the defacto complainant did not turn up. Since the petitioner has shifted his shop to another place, he has scrapped the old things including the defacto complainant's property. When the defacto complainant came for return of his property, the petitioner stated the facts. Hence the complaint.
3. On the basis of the complaint given by one Ramamurthy, enquiry was conducted. During the course of enquiry, according to the learned counsel for the petitioner, a compromise was reached between the parties to settle the matter for a sum of Rs.85,000/-. An amount of Rs.50,000/- was paid on 13.07.2023 and the petitioner has agreed to pay the remaining amount on or before 24.07.2023.
4. The respondent is present and admitted the compromise that was reached 2/4
between the parties.
5. Let the petitioner comply with the above said undertaking. Nothing survives for further adjudication in this case. Accordingly, this Criminal Original Petition is disposed of.
