Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the Impugned Order passed by the 1st respondent vide proceedings in No.23386/ThaKu.4/2024, Dated 05.06.2025 and Quash the same as illegal and void, consequently grant 6 days emergency leave without escort to the petitioner's husband A.K. Subbu @ Subramanian, S/o Krishnasamy (PID.No.235504) lodged at Central Prison, Trichy forthwith considering the representation, dated 9.5.2025. ORDER:

This Petition coming on for hearing on this day and upon perusing the petition and affidavit filed in support thereof and upon hearing the arguments Mr. C. Karthikeyan Advocate for the petitioner and of Mr. S. Ravi, Additional Public Prosecutor on behalf of the respondents the court made the following order:- (Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This petition is filed to extend the emergency leave granted by this Court in W.P.Crl.(MD)No.159 of 2025 dated 23.06.2025 for further period of 3 days to the petitioner's husband A.K.Subbu @ Subramanian, S/o.Krishnasamy(P.I.D.No.235504) 2/4

lodged at Central Prison, Trichy.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 3.The learned counsel appearing for the petitioner submitted that the petitioner is the wife of the convict prisoner. This Court, by order dated 23.06.2025, granted 6 days emergency leave to the convict prisoner for attending serious illness of his wife. Since the petitioner is suffering from Chronic Mastoiditis in both ears, the Doctor advised to take medicines for 5 days and to admit in the hospital on 05.07.2025. It is necessary for her husband to stay with her in the hospital till the surgery. Hence, he prays for extension of emergency leave, which was granted by this Court on 23.06.2025.

4.Taking into consideration the submission made by the learned counsel for the petitioner, this Court extends the emergency leave for further three days, ie., from 03.07.2025 to 05.07.2025. The convict prisoner shall report back to the Superintendent of Prison, Central Prison, Trichy, on 06.07.2025 at 10.30 a.m. The other conditions shall remain unaltered.
