ORDER
The petitioner herein seeks a direction to the third respondent to unblock the petitioner's patta in the Digital records, which was blocked without prior notice, in Patta No.5847 in S.No.877/5, Sernthamangalam Village, Kadaiyanallur Taluk, Tenkasi District. 2.Heard the arguments of Mr.M.Mahaboob Fazil, learned counsel appearing for the petitioner and Mrs.S.Jeyapriya, learned Government Advocate appearing for the respondents.
3.It is case of the petitioner that 0.22.5 Hectares lands situated in Survey No. 877/5, Sernthamangalam Village, Kadaiyanallur Taluk, Tenkasi District, was assigned in favour of the petitioner by the order passed by the third respondent on 27.11.2006. The petitioner has been cultivating the aforesaid land. Recently, without issuing any notice to the petitioner, the patta for the subject property in Patta No.5847 issued in
the name of the petitioner was blocked in the digital records. Therefore, the petitioner submitted a representation before the third respondent dated 05.07.2024 seeking unblocking of the patta in the digital records. The same has not been considered till date. Hence, the petitioner has come before this Court.
4.The learned Government Advocate appearing for the respondents would submit that the third respondent had already submitted a proposal for unblocking the pattas of individuals, which have been wrongly classified as Ananthinam before the second respondent on 26.12.2022. He would further submit that the competent authority to consider the request of the petitioner for unblocking the digital records is the Commissioner of Land Administration.
5.In view of the submissions made by the learned Government Advocate appearing for the respondents, the petitioner is directed to submit a fresh representation before the competent authority, namely, the Commissioner of Land Administration, within a period of two weeks from the date of receipt of a copy of this order. The second respondent
shall consider the proposal of the third respondent and file his report before the Commissioner of Land Administration through the first respondent within a period of six weeks from the date of receipt of the representation. The Commissioner of Land Administration shall consider the fresh representation of the petitioner, in the light of the report submitted by the second respondent and pass final orders on its own merits, within a period of eight weeks from the date of receipt of a report from the second respondent.
