ORDER
The present civil revision petition has been filed to set aside the fair and decreetal order dated 21.02.2025 made in I.A.No.5 of 2024 in O.S.No.47 of 2018 on the file of the Sub Court, Paramakudi. 1/4
2. The learned counsel for the petitioner vehemently contends that, if the documents is sent for stamping and registration, the same cannot be relied upon by the defendant. In support of this contention, he placed reliance on the following judgments of this Court. (i)Amudha and others Vs. K.Jeyaraman and others reported in 2005 3 L.W. 283.
(ii)Narayana Naicker and other Vs. Kannusamy Naicker (died) and others reported in 2019-3-L.W.19 (iii)Muthu Vs.Sampath and others reported in 2024 (6) CTC 399.
3. It is well settled principle of law that an unregistered document cannot be taken on record. For that purpose, this Court is empowered to impound the documents and send it for stamping and registration. This procedure will not deny the right of the petitioner from raising objections to the marking of the document when it is sought to be marked before the Court.
4. In view of the same, this Civil Revision Petition stands disposed of with the liberty to the petitioner to raise objections at the time of 2/4
marking the document. No costs. Consequently, the connected miscellaneous petition is closed.
