Respondent PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to forthwith refund the sum of Rs.92,05,396.01 (Rupees ninety two lakhs five thousand three hundred ninety six and paise one) together with commercial rate of rate of interest at 18% p.a., to the petitioner within a reasonable time as may be fixed by this Court.

O R D E R

The petitioner seeks for a direction to the respondent to refund a sum of Rs.92,05,396.01 together with interest, which has been paid by the petitioner to the respondent by way of security deposit in respect of a contract awarded to him in executing certain works in the respondent / Corporation.

2.According to the petitioner, even though the petitioner has successfully completed the work, the security deposit paid by him has not been refunded. It is needless to say that it is for the respondent to consider the request of the petitioner and therefore, this Court at this stage is not expressing any view on the claim made by the petitioner. It is also seen that the petitioner has made two representations dated 07.08.2015 and 18.09.2015, which are said to be pending. 3.Therefore, the 2nd respondent is directed to consider the representations of the petitioner and pass orders on merits and in accordance with law within a period of 4 weeks from the date of receipt of a copy of this order.
