O R D E R
(Order of the court was delivered by G.R.Swaminathan, J.) The brother of the detenue is the petitioner before us. The detenue was detained as "Bootlegger" by the District Magistrate and District Collector, Sivagangai District vide detention order dated 21.05.2024. The detenue submitted her representation which was received on 31.05.2024. It was dealt with by the Deputy Secretary on 14.06.2024. The Hon'ble Minister dealt with the file on 22.06.2024. During the intervening period, three days were declared as holidays. The delay of remaining four days remains unexplained. It is well settled that delay in considering the representation of the detenue is fatal to the continuance of the detention.

2.In this view of the matter, we hold that the detenue's continued detention is illegal. She shall be set at liberty forthwith unless her detention is otherwise warranted by law.
3.This habeas corpus petition is allowed accordingly. (G.R.S. J.,) & (R.P. J.,) 19.11.2024 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias Issue order copy on 20.11.2024.
