2 W.P.(MD)NO.17998 OF 2025 Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the third respondent from registering any encumbrance / transaction in respect of the land comprised in S.No.46/8A, 46/9A an extent of 61 cents situated in Orathattu Village, Nilakottai Taluk, Dindigul based on the petitioner's representation dated 13.06.2025. Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the second respondent and the learned Additional Government Pleader appearing for respondents 1 and 3.
2. The fourth respondent has been served and his name is also printed in the cause list. However, he has not chosen to enter appearance.
3. The petitioner is a resident of Chinnamanoor. He claims to be a devotee of the fifth respondent temple. The only prayer made in the writ petition is that the registering authority should not 2/4
3 W.P.(MD)NO.17998 OF 2025 entertain any document in respect of the petition-mentioned survey numbers.
copy of the proceedings bearing Na.Ka.No.28013/2022/D6 dated 22.11.2024 passed by the District Revenue Officer, Dindigul clearly states that the petition-mentioned survey numbers stands in the name of the fifth respondent temple. So long as the said proceedings are holding good, the registering authority shall not entertain any document in respect of the said survey numbers. I further make it clear that if any challenge mounted against the aforesaid proceedings dated 22.11.2024 passed by the District Revenue Officer, Dindigul, the fifth respondent temple should be made as a party respondent and without hearing the fifth respondent, no prejudicial order can be passed. It is further made clear that in future, if there is any subsequent development, the registering authority will have to notify the fifth respondent. This writ petition stands allowed on these terms. No costs. Consequently, connected miscellaneous petition is closed.
