O R D E R
The Petitioner herein seeks a direction to the second respondent to dispose of the Petitioner's appeal, dated 14.06.2025 filed under Section 12 of the Tamil Nadu Patta Passbook Act, 1983. 2.Mrs.S.Jeya Priya, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the petitioner that the property in S.No. 2215/5D2 situated at Thimmarasanaickanur Bit-II, Andipatti Taluk, Theni District originally belong to the Petitioner's mother Kamatchiammal. Patta was also issued in her favour in Patta No. 4438. Subsequently, name of one Sivakumar was added as joint pattadhar without notice to the original pattadhar. Hence the Petitioner in his capacity as one of the legal heirs of Kamatchiammal, filed a Petition before the second respondent seeking deletion of Sivakumar's name from patta for the subject 2/5
property on 14.06.2025. The said appeal filed by the Petitioner has not been considered till date. Hence the Petitioner has come before this Court by filing the present Writ Petition for the relief stated supra.
4.Mrs.S.Jeya Priya, learned Government Advocate, who takes notice for the respondents 1 to 3 would submit that the appeal filed by the Petitioner will be considered on its own merits within the time stipulated by this Court.
5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the appeal filed by the Petitioner, dated 14.06.2025 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and the above said Sivakumar within a period of 12 weeks from the date of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
