BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 01.08.2024

CORAM

THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN Beula Jebarani ... Petitioner Vs.

1.The District Collector, Collectorate Campus, Thoothukudi, Thoothukudi District.

2.The Revenue Divisional Officer, Revenue Divisional Office, Kovilpatti, Thoothukudi District.

3.The Tahsildar, Taluk Office, Vilathikulam Taluk, Thoothukudi District.

... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 3rd respondent to issue patta in my name in respect of the property comprised in Natham Old S.F.No.50/8 UDR Natham S.F.No.370/31 to an extent of 8000 Sq Ft and to upload the same in the Government Portal Website. 1/4

For Petitioner : Mr.R.Murugan For Respondents : Mr.K.Balasubramani, Spl. Government Pleader.

ORDER

Heard both sides.

2.The petitioner had already filed W.P.(MD)No.8378 of 2024. The said writ petition was disposed of by directing the jurisdictional Tahsildar to hold enquiry and pass final order. The learned Special Government Pleader would complain that even though the petitioner had been summoned for enquiry, she is refusing to cooperate.

3.When I wanted to know as to why a second writ petition has been filed on the same cause of action, the learned counsel for the petitioner clarified that the extent was wrongly mentioned on the earlier occasion. 4.I am of the view that for this reason, there is no need to file one more writ petition. Since the Tashildar, Vilathikulam is seized of the matter, based on the petitioner's entitlement, patta will be issued. The third respondent will not go by the writ prayer.
