Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to pay the terminal benefits amount payable to the petitioner such as P.F., and refund amount of Post Retirement Scheme amount of Rs.22,364/- together with 6% interest from the date of death of her husband i.e., 07.09.2019 to till the date of payment to her within the stipulated period.

ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The limited prayer sought for in the present Writ Petition is for disbursal of sum of Rs.22,364/- towards Provident Fund and Post Retirement Benefits Scheme as well as for interest on the belated payment of the benefits.

3. When the petitioner herein had made an application under the Right to Information Act for details of her entitlement for the Provident Fund and Post Retirement Benefits Scheme, the respondents herein, through an order dated 06.08.2022, had replied stating that the petitioner is entitled for a sum of Rs.22,014/- towards Provident Fund and Rs.350/- towards Post Retirement Benefits Scheme. Admittedly, the aforesaid sum has not been paid to the petitioner at the time of the death of her husband, i.e., on 07.09.2019. 2/4

In the light of the information supplied by the respondents herein, there shall be a direction to the respondents to consider the petitioner's representation, dated 13.06.2022, within a period of eight (8) weeks from the date of receipt of a copy of this order and disburse the said amount of Rs.22,364/- together with interest at the rate of 6% from the date on which the amount is due to the petitioner herein.

5. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
