ORDER : The Court made the following order :- The petitioners/A1 to A3, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 131, 308(4) of BNS, 2023 r/w. Section 23 of Maintenance and Welfare of Parents and Senior Citizens Act in Crime No.232 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 26.05.2025, at about 7.00 p.m., the petitioners abused the de-facto complainant using filthy language and also threatened her with dire consequences. Hence, the present case.

The learned counsel appearing for the petitioners submitted that the 1st petitioner is the son of the de-facto complainant and the 2nd petitioner is her daughter-in-law, and the 3rd petitioner is her grandson. The petitioners are innocent persons and are in no way connected with the alleged occurrence as stated by the prosecution. Due to a pending partition dispute between the 1st petitioner, the defacto complainant and her daughter, the de-facto complainant lodged the present false complaint against the petitioners. He, however, submitted that the petitioners are willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioners.

4. The learned counsel for the intervenor submitted that the de-facto 2/6

complainant is a senior citizen, aged about 85 years, and a widow. The 1st and 3rd accused attacked the de-facto complainant and issued life threats to her. He submitted that gold jewels weighing 33 sovereigns are in the possession of the petitioners. He further submitted that if the petitioners are granted anticipatory bail, they may be directed to appear before some other police station. However, he strongly opposed to grant anticipatory bail to the petitioners.

5. The learned Government Advocate (Crl. side) submits that the petitioners have been arrayed as A1 to A3 in this case. The 1st accused, along with other accused, assaulted his own mother, who is a senior citizen. He further submitted that the injured was treated only as an outpatient. However, he opposed to grant anticipatory bail to the petitioners.

Taking into consideration of the facts and circumstances of the case and the nature of the offence, and also taking note of the fact that the date of occurrence is 02.01.2025, but the FIR was registered only on 26.05.2025, and that by this time most of the investigation might have been completed, and that the injured was treated only as an outpatient, this court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions.

7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which 3/6

the order copy made ready, before the learned District Munsif cum Judicial Magistrate, Thottiyam, on condition that the petitioners shall execute a bond for a sum of Rs.

25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned District Munsif cum Judicial Magistrate, Thottiyam, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: (a) the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioners shall furnish their residential address and mobile number to the learned District Munsif cum Judicial Magistrate, Thottiyam.

In the event of any change in their residential address, the petitioners shall report the same to the learned District Munsif cum Judicial Magistrate, Thottiyam; (c) the petitioners shall stay at Namakkal District and sign before the Inspector of Police, Mohanur Police Station, Namakkal daily twice i.e. at 10.00 a.m. and 05.00 p.m.

(d) the petitioners shall not tamper with evidence or witness either during investigation or trial;

(e) the petitioners shall not abscond either during investigation or trial; (f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court themselves as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and; (g) if the accused/petitioners thereafter abscond, a fresh FIR can be registered under Section 269 of BNS, 2023.
