COMMON PRAYER: Petitions filed under Article 226 of the Constitution of India, to issue a Writs of Certiorari, calling for the records relating to the impugned sale notice dated 18.07.2022 issued by the 1st respondent, and quash the same.

[Order of the Court was made by The Hon'ble CHIEF JUSTICE] We have heard the learned counsel for the petitioner and the learned counsel for the respondent Bank.

2. The writ petitions are filed in the year 2022 challenging the sale notice. Interim order was passed by this Court.

3. The learned Advocate for the bank submits that sale could not proceed further because of the interim order passed by this

Court and now if the bank wants to sell the property, a fresh sale notice will have to be issued.

4.In that event, if the petitioner is aggrieved by the fresh sale notice, then the same can be challenged before the Debt Recovery Tribunal on permissible grounds.
