2. The respondents are served and description is printed in the cause list.

3. Having regard to the averments contained in the petition, the quantum of delay and the rival contentions made, we are of the view that the delay may be condoned. The delay of 33 days in filing the Writ Appeal is condoned and this Miscellaneous Petition is ordered.

4. Registry is directed to number the Writ Appeal, if it is otherwise in order and list the same for admission. The names of the learned counsel who have entered appearance now will continue in the cause list as and when the matter is listed.
