ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the respondents 1 and 2 and learned Government Advocate (Crl.Side) for the third respondent.

2. The petitioner appears to have applied for passport on 07.05.2025. However, it has not been processed by the first respondent.

3. It appears that the petitioner has been arrayed as A5 in FIR registered by the third respondent/Police in Crime No.214 of 2024 for the offences under Section 189(2), 126(2) and 286 BNS, 2023.

4. The learned Government Advocate (Crl.Side) for the third respondent also submits that the aforesaid complaint has been taken on file and charge sheet has been filed before the learned Judicial Magistrate, Pudukottai in S.T.C.No.615 of 2024.

5. Considering the fact that the case is pending against the petitioner before the Criminal Court, there cannot be a direction to issue the passport. However, it is open for the petitioner to move a suitable application before the Judicial Magistrate, Pudukottai in S.T.C.No.615 of 2024 for facilitating the first respondent to process the passport application of the petitioner.

6. The learned Judicial Magistrate, Pudukottai shall consider the plea of the petitioner, if the offences registered against the petitioner are not serious in nature.
