PRAYER :- To enlarge the petitioner on bail in S.C.No.171/2022 on the file of the Sessions 1/4
Judge,Mahila Court,Tiruchirappalli in Crime No.844 of 2022 of the file of the respondent police.
ORDER : The Court made the following order :- The petitioner /sole who was arrested and remanded to judicial custody on 13.07.2022 for the offences under sections 302,364 of IPC in Crime No.844 of 2022 on the file of the respondent police seeks bail. 2.This is the second bail petition filed by the petitioner. The earlier petition was dismissed by this Court in Crl.O.P(MD)No.3685 of 2023 on 10.03.2023 with a direction to dispose the trial within a period of three months, from the date of receipt of copy of the order. Since the petitioner is in custody for more than one year, Order in Act - 14 has been quashed against the petitioner and trial has also been commenced in this case, seeking bail this petition is filed for the second time. 3.In this regard, a report is called from the trial Court with regard to the stage of trial and the same was received stating that in pursuant to the direction issued by this Court, trial has commenced out of 21 witnesses, nine witnesses have been examined so far.
4.Pending trial, this petition has been filed seeking for bail. Since a direction has been issued to complete the trial within a stipulated period, if the petitioner is released on bail, he may abscond and hamper the Trial. Hence, this 2/4
Court finds no reason to enlarge the petitioner on bail, though this is the second petition.
5.Accordingly, this Criminal Original Petition stands dismissed. The trial Court is directed to complete the trial, within the stipulated period as directed by this Court.
