Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records relating to the proceedings of the impugned notice in Memo.No.CFL/RCMDU/PR26/2023, dted 30.06.2023 on the file of the respondent and quash the same.

ORDER

This Writ Petition has been filed to call for the records relating to the proceedings of the impugned notice in Memo. No.CFL / RC -MDU/ PR26/ 2023, dated 30.06.2023 on the file of the respondent and quash the same.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Today, when the matter was taken up for hearing, the learned Standing Counsel appearing for the respondents would submit that similar matter was placed before the Principal Bench and the impugned order with respect to the similarly person was quashed in WP(MD).No.20528 of 2023, dated 14.07.2023. Hence, it was submitted that the respondent University may be permitted to withdraw the order, dated 30.06.2023 for the purpose of following the similarity between the case filed by the identical person viz., B.Lakshmipathi before the Principal Bench of this Court. 2/4

4. In view of the same, the syndicate of the respondent University is directed to withdraw the impugned order, dated 30.06.2023 and also considering the order passed by the Principal Bench of this Court in W.P(MD).No.20528 of 2023 shall deal with the matter in accordance with law.

5. With the above observation, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petitions are closed. 28.07.2023 Index : Yes / No Internet : Yes/ No trp To The Registrar.
