Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents No.1 to 6 to take action to appoint scavenger in Panchayat Union Middle School, Valaikurichi, Pudukottai District and to remove caste name mentioned in the identification cards which are issued to the students in Panchayat Union Middle School situated in the village of Valaikurchi and to direct the respondents No.1 and 2 to take action on the basis of the representations preferred by the petitioner dated 01.08.2019 and 16.08.2019.

O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct the respondents 1 to 6 to take action to appoint Scavenger in Panchayat Union Middle School, Valaikurichi, Pudukottai District and to remove caste name mentioned in the identification cards which are issued to the students in Panchayat Union Middle School situated in the village of Valaikurchi.

2. With reference to the grievances of the petitioner, the official respondents filed a counter stating that the practice of compelling the students to clean the toilets was identified and actions were initiated. All those Teachers, who all are responsible were transferred immediately. At present, Scavengers are appointed in the school. Therefore, the issue raised by the petitioner has been settled by the authorities.

3. No doubt, the practice of compelling the students to clean the toilets, at no circumstances, be tolerated by the Courts. It is an offence and such Teachers are liable to be punished by initiating disciplinary proceedings. If at all any such practice exists as of now, 3/6

the petitioner is at liberty to give a complaint to the Educational Authorities, who in turn, are bound to initiate appropriate action.

4. With the above liberty, this Writ Petition stands disposed of. There shall be no order as to costs.
