ORDER

This criminal original petition has been filed to direct the respondents not to harass the petitioner in respect of his practice of providing first aid medical service in allopathy without following the due process of law.

2.The case of the petitioner is that he is Diploma holder in First Aid and Practical Nursing and he is registered member of the Tirupur District Private Rural Medical Practitioners Association. The petitioner has been practicing in first aid allopathic system of medicine in rural area for more than ten years and he is not involved in any minor and major surgery. However, the second respondent preferred a complaint before the first respondent alleging that the petitioner involved in treatment for serious ailment and based on the complaint, the first respondent harassed the petitioner, even though the petitioner explained his case. Hence, the petitioner filed the present petition seeking the aforesaid relief.

3.The learned Additional Public Prosecutor appearing for the first respondent, on instructions, would submit that based on the complaint given by the second respondent, the first respondent enquired the petitioner and the petitioner produced the relevant certificate. Crl.O.P.(MD)No.14974 of 2020 will not interfere in the business of the petitioner and there is no harassment as against the petitioner.
