an extent of 0.03.75 Hectares and S.No.118/4B2 of an extent of 0.03.25 Hectates situated at Kodangipatti Village, Vadipatti Taluk, Madurai District, with adequate police protection based online application of the petitioner in No.2025/0123/24/018/708 dated 05.08.2025 and 22.05.2026 within the time stipulated by this Court.

ORDER
The present writ petition has been filed for a Mandamus, directing the official respondents to survey and demarcate the property.

The petitioner is claiming right over the property in Survey No. 118/4B1 to an extent of 0.03.75 Hectares and Survey No.118/4B2 to an extent of 0.03.25 Hectares situated at Kodangipatti Village, Vadipatti Taluk, Madurai District. The said property originally belonged to one Andiappa Gounder. The said Andiappa Gounder executed a gift settlement in favour of his son namely, Murugesan and his grandson namely, Madhupani Theerthagiri vide Document No.71/2017 dated 2/6
12.01.2017 in respect of 9 cents of land. The said Andiappa Gounder has also executed a gift settlement deed in favour of the petitioner vide Document No.70/2017 dated 12.01.2017. The said property was purchased by Andiappa Gounder through the sale deed dated 14.06.1990 in Document No.1022/1990. Thereafter, the petitioner was in possession and enjoyment of the property based on the settlement deed as stated supra. The petitioner is seeking to survey and demarcate the property. The patta also stands in the name of the petitioner. Therefore, the 1st respondent/Tahsildar is directed to survey the property after issuing notice to the petitioner as well as the 4th respondent. In case, the Tahsildar is seeking police protection, the 3rd respondent shall provide the same. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
3. This Court is directing the 1st respondent to adhere to the following Standard Operating Procedures:
a.
The 1st respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving 3/6
the notice of survey.
b.
After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
c.
If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.
The aforesaid procedure shall be strictly followed by the parties.
4. With the above direction, the Writ Petition is disposed of. No costs.
