PRAYER: Writ Petition filed under Article 226 of the Constitution of India, directing the 1st respondent to remove the illegal construction of the 2nd and 3rd respondents.

O R D E R

[Order of the Court was made by T.S.SIVAGNANAM,J.] The petitioner seeks for a direction to the first respondent to remove the illegal construction of the second and third respondents.

2. The petitioner is the sister of the respondents 2 & 3. The parties are before the Civil Court in a partition litigation. In the meantime, there is an allegation that an unauthorized construction has been put up. The complaint in this regard has been sent to the first respondent. Thus, it appears that the complaint is motivated. However, if there is any unauthorized construction, it is always open to the petitioner to complain before the Commissioner of Municipal Corporation, who can always take action, for which, no direction is required from this Court.

3. With these above directions, this Writ Petition stands disposed of. No costs.
