PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to take necessary action upon the Petitioner's representation, dated 4.7.2023, wherein, seeks to cancel the patta bearing Nos.1408 and 2447 in favour of the respondents 5 and 6 issued by the fourth respondent and consider the same in the light of order issued by the third respondent in Oo.Mu.NO.7107/2023/A3, dated 18.11.2023.

The Petitioner herein seeks a direction to the respondents 1 to 4 to consider his representation dated 4.7.2023 seeking cancellation of patta issued in the name of respondents 5 and 6. 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 to 4. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against respondents 5 and 6, notice to them is dispensed with.

3.According to the Petitioner, he is the owner of the subject property in S.No.494/5, situated at Pulimankombai Village, Aundipatti Taluk, Theni District It is the specific case of the Petitioner that the respondents 5 and 6 by producing bogus documents, obtained patta for the subject property in their favour. Therefore, the Petitioner submitted a representation on 4.7.2023 before the third respondent seeking cancellation of patta issued in favour of respondents 5 and 6. The same has not been considered till date. Hence, the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.Mrs.K.

Malathi, learned Additional Government Pleader who takes notice for the respondents 1 to 4 would submit that the representation submitted by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the Petitioner, dated 04.07.2023 and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and private respondents 5 and 6, within a period of 12 weeks from the date of a copy of this order.

6.With the above directions, the Writ Petition stands disposed of. No costs.
