JUDGMENT

[Judgment of the Court was made by R.SUBRAMANIAN, J.] Mr.S.R.A.Ramachandran, learned Additional Government Pleader takes notice for the respondents.

2.The challenge in the Appeal is to the order of the Writ Court upholding the cancellation of the assignment. 3.The Writ Court had found that the appellant had violated the conditions of assignment, namely, to bring the land into cultivation within the specific period. The appellant contended that the land is not fit for cultivation. The Writ Court has chosen to reject the said contention. It is also the finding of the Writ Court that the land is being used for quarrying activities, which is also against the conditions of assignment. We do not see any reason to interfere with the order of the Writ Court. 4.The Writ Appeal is therefore, dismissed. The assignment was made to poor landless persons. If the petitioner is qualified for assignment even today, he is at liberty to apply for assignment afresh and if he applies for

such assignment, the authorities will consider the same sympathetically. No Costs. Consequently, connected miscellaneous petition is closed.
