O R D E R

This Writ Petition has been filed seeking a direction to the respondent to grant permission and to give adequate police protection for conducting Adal Padal Programme on 05.09.2019 in pursuant to Arulmigu Adhi Kopurathu Muniyasami Thirukoil Festival situated at Muyaltheevu Area, Meenavar Colony, Thoothukudi District.

2. Heard both sides.

The grievance of the petitioner is that seeking permission to conduct the temple festival and protection to conduct the Cultural Programme on 05.09.2019 in the above said temple, the petitioner made a representation on 17.08.2019 to the respondent and the said representation was not considered so far. Hence, the present Writ Petition has been filed for the aforesaid relief.

4. The learned Government Advocate (Crl.side) would submit that if the temple festival is conducted, it is likely to create law and order problem in that area.

The learned counsel appearing for the petitioner would submit that every year, the temple festival is being conducted and so far no untoward incident had happened in that area and even in the year 2017, this Court had granted permission to the petitioner to conduct the temple festival in W.P.(MD).No.16109 of 2017, dated 28.08.2017. The leaned Government Advocate (Crl.side) has also not disputed the above said fact.

Considering the fact that the petitioner has conducted the temple festival in the year 2017 and so far no untoward incident had happened in the temple festival, apart from that, this Court has also granted permission to the petitioner to conduct a temple festival in the year 2017, the respondent is directed to consider the petitioner's application afresh and pass suitable orders granting permission by imposing necessary condition for maintaining law and order in that area.

7. With the above directions, this writ petition is disposed of. No costs.
