For Respondent : M/s.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime.No.297 of 2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence punishable under Section 341, 294 (b), 387 and 506(ii) IPC, in Crime No.297 of 2021, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that on 14.09.2021, the petitioner along with other accused abused the defacto complainant in filthy language and extorted Rs.1,000/- from him and also threatened him with dire consequences.
3. The learned counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case in order to curtail the forthcoming Panchayat Election. https://hcservices.ecourts.gov.in/hcservices/
In fact, the petitioner was the Vice President of Valliyoor Panchayat and he was holding the said post till his period was over. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) opposed for grant of anticipatory bail on the ground that apart from this case, the petitioner is also involved in 39 cases, out of which, 7 cases are still pending.
5. The learned counsel for the petitioner disputed the same and submits that almost all the cases have been ended in acquittal.
6. Considering the nature of offence and also considering the fact that the petitioner is involved in 39 cases and 7 cases are still pending, this Court is not inclined to grant anticipatory bail to the petitioner.
