The present petition has been filed under Section 482 of Criminal Procedure Code praying to call for the records in Special SC.No.62 of 2020 on the file of the Special Court for Exclusive Trial of Cases under POCSO Court, Thoothukudi and quash the same on the basis of the Joint Compromise Memo dated 11.12.2020.
2. A perusal of the records shows that a case was registered in Crime No.4 of 2020 for the offences punishable under Sections 5 (1), 5 (n) r/w 6 of POCSO Act, 2012 and that the final report was also filed before the Special Court for Exclusive Trial of Cases under POCSO Court, Thoothukudi in Special SC.No.62 of 2020.
3. In the present petition, the defacto complainant has contended that no such occurrence took place as mentioned in the complaint and that the respondents 2 and 3 have also "forgotten the incident". The police after conducting investigation has laid a charge sheet in Special SC.No.62 of 2020 on the file of the Special Court for Exclusive Trial of Cases under POCSO Court, Thoothukudi https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.OP(MD).No.15908 of 2020 under Sections 5 (1), 5 (n) r/w 6 of POCSO Act, 2012.
4. In the facts and circumstances, I do not see any reason to record any compromise between the parties. Accordingly, this petition is dismissed.
