ORDER : The Court made the following order : The petitioners, apprehending arrest against the non bailable warrant issued in C.C.No.124 of 2020 on the file of the learned Additional District Munsif cum Judicial Magistrate, Manamadurai seek anticipatory bail.

2.The prosecution case is that the defacto complainant filed a petition in Cr.M.P.NO.1165 of 2020 before the learned Judicial Magistrate, Manamadurai under Section 156(3) CrPC and based on the complaint the learned Magistrate issued summons to the husband, mother and the petitioners herein. However, the petitioners did not appear before the Court and therefore, a non bailable warrant of arrest was issued against the petitioners.

3.The learned Counsel for the petitioner submits that the petitioners are innocents and they have not committed any offence. Moreover, the petitioners are sisters-in-law of the defacto complainant. However, they are married and settled in other places. However, they have also been implicated in this case. 4.Taking into consideration of the facts and circumstances of the case, the nature of allegations and the petitioners being inlaws of the defacto complainant, this Court is inclined to grant anticipatory bail to the petitioners.

Accordingly, this petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Additional District Munsif cum Judicial Magistrate, Manamadurai, on condition that the petitioners shall execute a bond for a sum of Rs.

[b] the petitioners shall report before the respondent police as and when required for interrogation; [c] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [d] the petitioners shall not abscond either during investigation or trial;

[e] on breach of any of the aforesaid conditions, the learned Judge/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners have been released on bail by the learned Judge/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and; [f] if the accused / petitioners thereafter abscond, a fresh FIR can be registered under Section 229-A IPC. sd/- 25/10/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
