PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C 1/4

PRAYER :- For Anticipatory Bail in Crime No.15 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 294(b), 498(A) and 506(i) of IPC, in Crime No.15 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant's version is that she got married to the first accused on 16.03.2006 and they were blessed with two children. It is alleged that the first petitioner had affairs with another woman and refused to give money to the defacto complainant and also refusing to pay EMI for their housing loan. Hence the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent, they have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution.

4. Learned Additional Public Prosecutor would submit that the matter was already referred to the Mediation and a settlement was reached between the parties 2/4

in the Mediation Centre. The parties have decided to live together. Hence, the matter has become infructuous.

5.Let the parties appear before the respondent police along with the terms of the compromise, annexed along with the order copy and give a statement with regard to the settlement reached between them, so that the respondent can close the case recording the settlement.
