Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the first respondent vide proceedings in No. RO.TRY/294/2026 -CA Dated 29.05.2026 and quash the same as illegal and consequently direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner, namely, Amjathkhan, s/o. Sheik Dawood, aged about 51 years, life convict, PID No.318886 confined at Central Prison, Trichy. O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the impugned proceedings of the first respondent made in No. RO.TRY/294/2026 -CA Dated 29.05.2026, wherein, the first respondent while granting 21 days ordinary leave imposed a condition that the convict will be accompanied by an escort. This condition has been put to challenge in the present writ petition.

2. Heard the learned counsel on either side.

3.The petitioner is presently undergoing sentence at Central Prison, Trichy. A representation was made to the first respondent seeking for ordinary leave and the first respondent considering the representation granted 21 days ordinary leave, however, imposed a condition that the convict will be accompanied by an escort. This condition has been put to challenge in the present writ petition.

4. The learned counsel for the State of Tamil Nadu (Criminal Side) on instructions submitted that the petitioner has undergone sentence of four years, four months and three days and till now, the petitioner has not availed either ordinary leave or emergency leave.

5. Taking into consideration the facts and circumstances of the case and considering the reason for which the ordinary leave has been sought for, we are inclined to modify the condition imposed by the first respondent to the effect that the convict will report before the fourth respondent daily at 05.00 p.m., during the entire period of ordinary leave. The other conditions imposed by the first respondent shall stand as it is. The sureties will be furnished by the convict before the jail authorities.

6. This Writ Petition (Criminal Side) is disposed of in the above terms.

7. It is made clear that during the entire ordinary leave period, the convict will not cause any disturbance to the victim girl or her family.
