ORDER

Heard both sides.

2.The writ petitioner is a resident of Vadiyakadu Village, Pattukottai Taluk. He alleges that the petition mentioned water channel has been encroached. He wants the same to be cleared. Since action was not taken, this writ petition came to be filed. 3.When the matter was taken up for hearing, the learned Government Advocate on instructions submitted that the jurisdictional Assistant Executive Engineer of Water Resources Department has already written to the Tahsildar, Pattukottai to issue Form I. 2/6

4.We direct the fourth respondent to issue notices to all the interested persons and conduct survey. Based on the survey results, the competent authority under the Tamil Nadu Protection of Tanks and Eviction of Encroachment Act, 2007, will take consequential action. In any event, all the encroachments in the petition mentioned water channel should be removed within a period of four months from the date of receipt of a copy of this order.
