For Respondent : Mr.A.Robinson Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.591 of 2019 on the file of the respondent ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent Police for the offences under Sections 147, 148, 294(b), 341, 324 and 506(i) of IPC in Crime No.591 of 2019. They seek anticipatory bail.

2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl.side) appearing for the respondent.

3.The defacto complainant said to have been injured near his eye. He was in Hospital for about seven days. 4.The learned counsel appearing for the petitioner submitted that the petitioners are not having any previous case. FIR was registered only on 20.08.2019, even though the occurrence is said to have taken place on 12.08.2019.

5.The learned counsel appearing for the intervener would submit that their initial complaint was not registered by the respondent and that, only after submitting their representation to the Superintendent of Police, the case came to be registered. 6.In as much as, the victim suffered only contusion and since the petitioners are not having any bad antecedents, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Natham and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only)each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
