PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to issue a direction to withdraw the case in Cr.No.130 of 2026 on the file of the 2nd respondent and entrust the same to the competent some other investigating agency and to file a charge sheet before the competent court within the time stipulated as fixed by this Court and pass such any further order or orders. ORDER

The present petition has been filed by the defacto complainant in Crime No.130 of 2026 on the file of the 2nd respondent police, seeking a direction to transfer the investigation and to file a charge sheet before the competent Court.

2. The learned Government Advocate (Criminal Side) appearing for the 2nd respondent submitted that a Referred Charge Sheet (RCS) notice was served on the petitioner on 05.06.2026.

3. However, the learned counsel appearing for the petitioner submitted that so far, the petitioner has not received any RCS notice from the concerned Court.

4. In view of the above facts, the petitioner is always at liberty to file a protest petition before the concerned Court upon receipt of the RCS notice from the concerned Court.

5. With the said observations, this Criminal Original petition Stands closed.
