Crime No. 535/2021 Respondent Prayer : This Criminal Miscellaneous Petition is filed under Section 528 of BNSS, 2023, to permit the petitioner to withdraw the deposited amount of Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.535 of 2021 on the file of the learned Principal District and Sessions Judge (Special Court to deal with offences under the Mines and Minerals Act), Kaur and to return the original Registration Certificate of the petitioner's JCB vehicle bearing Registration No.TN-32-J-4532, in Crl.R.C.(MD)No.837 of 2021 dated 25.11.2021.

ORDER

While disposing of the Revision Case in Crl.R.C.(MD)No.837 of 2021, by an order dated 25.11.2021, this Court allowed the Criminal Revision Case, on conditions that the petitioner was directed to deposit a sum of Rs.2,00,000/- to the credit of Crime No.535 of 2021 on the file of the learned Principal District and Sessions Judge, (Special Court to deal with offences under the Mines and Minerals Act), Karur, within a period of two weeks from the date of receipt of a copy of that order and to deposit the original Registration Certificate of the vehicle with the learned Principal District and Sessions Judge, (Special Court to deal with offences under the Mines and Minerals Act), Karur.

2.In the meanwhile, the said case has culminated in C.C.No.32 of 2024 on the file of the learned District Munsif cum Judicial Magistrate, Krishnarayapuram, and after elaborate trial, the said case was ended in acquittal on 30.10.2024. Pursuant to the same, the petitioner has filed this petition, seeking to withdraw the deposited amount of Rs.2,00,000/-, which has been credited in Crime No.535 of 2021 on the file 2/4

of the learned Principal District and Sessions Judge, (Special Court to deal with offences under the Mines and Minerals Act), Karur, and to return the original Registration Certificate of the petitioner's vehicle. 3.Since the case in C.C.No.32 of 2024 was ended in acquittal, the learned Principal District and Sessions Judge, (Special Court to deal with offences under the Mines and Minerals Act), Karur, is directed to return the deposited amount and the original Registration Certificate of the vehicle, on the petitioner making a suitable application in this regard within a period of four weeks from the date of receipt of copy of this order.
