ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) The Habeas Corpus Petition is filed for a direction to the second and third respondents to secure and produce the person or body of the detenue namely Afrin, daughter of Thajudeen, aged about 22 years before this Court and set her at liberty.
2.It is the case of the petitioner that the alleged missing person is his third daughter viz., Afrin and she has completed B.S.C(Chemistry) and that on 25.06.2025 when the petitioner along with his wife went to distribute the invitation cards, his daughter had gone out of the house. Since the whereabouts of his daughter is not known, the petitioner had lodged a complaint before the 2/6
second respondent on 26.06.2025. Based on which, the second respondent registered a case in Crime No.318 of 2025 on 28.06.2025. Since no action has been taken by the respondents police, the petitioner has come up with the present Habeas Corpus Petition.
3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 4.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondent police submitted that based on the complaint given by the petitioner, a case in Crime No.318 of 2025 was registered under Woman Missing. While so, the daughter of the petitioner along with one Navinkumar had appeared before the Superintendent of Police, Cudalore District, on 05.07.2025 and gave a statement that she fell in love with one Navinkumar and that her parents coming to know about her love, had arranged marriage proposal. Since the petitioner's daughter was not interested in the said marriage, she had left the home on her own volition and got married to one Navinkumar on 05.07.2025 and that she is living with her husband Navinkumar and apprehending 3/6
threats from her parents, she has also requested the respondent police for taking appropriate action against her father. Further submitted that the petitioner's daughter is not in illegal detention of anybody and that Cudalore Police are also taking appropriate action to ensure that they are protected. 5.Recording the aforesaid submissions and since the missing person is not under illegal detention of anybody, this Habeas Corpus Petition stands closed.
