For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.467 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner herein is the sole accused in Crime No.467 of 2019 registered on the file of the respondent for the offences under sections 406, 408 and 420 of I.P.C.

3.The petitioner admits that he has to pay a sum of Rs.6,69,000/- to the affected parties.

4.The petitioner's counsel has filed an affidavit before this Court that he undertakes to deposit the said sum of Rs.6,69,000/- to the credit of Crime No.467 of 2019 on the file of the respondent before the Judicial Magistrate No.I, Virudhunagar on or before 10.12.2019.

CRL OP(MD). No.11968 of 2019 5.Recording the said undertaking, anticipatory bail is granted. It is made clear that if this undertaking is breached, the order now passed will stand automatically vacated. The petitioner's counsel also gives further undertaking, on instructions, that he will not apply for modification or extension of the condition now imposed.

6.Accordingly, petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Virudhunagar, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
