ORDER

The petitioner has submitted a representation dated 22.03.2023 before the third respondent, seeking issuance of patta for the land in Survey No.40/3A1 situated at Ramankulam Village, Madurai South Taluk, Madurai. Since the said representation has not been considered, the petitioner has filed this writ petition.

Ms.D.Farjana Ghoushia, learned Special Government Pleader, on instructions, submits that the petitioner has submitted a similar representation before the 3rd respondent on 26.09.2020 for grant of patta for the land in Survey No.40/3A1, which was rejected by the third respondent, by order dated 24.12.2020, on the ground that it has been undefined. As against the order dated 24.12.2020, the petitioner is having an appeal remedy before the second respondent/the Revenue 2/5

Divisional Officer, Madurai.

3. The learned counsel appearing for the petitioner claims that the order dated 24.12.2020 had not been furnished to the petitioner and therefore, he was not aware of the same.

Considering that the earlier representation of the petitioner was rejected by the third respondent by order dated 24.12.2020 and the petitioner is having an appeal remedy before the second respondent/the Revenue Divisional Officer, Madurai, this writ petition is disposed of by granting liberty to the petitioner to file an appeal under Patta Pass Book Act before the second respondent/the Revenue Divisional Officer, Madurai within a period of 15 days from the date of receipt of a copy of this order. No costs.
