Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 2nd respondent to dispose of the Appeal filed on 12.06.2014 and 21.07.2022 and grant patta in favour of PALLATHALA AMMAN deity in respect of the property comprised in Old Survey No.125, New Survey No.125/2, which is an extent of 6 acres bearing old Patta No.4.

ORDER

The petitioner herein seeks a direction to second respondent to dispose of the Appeal filed by the petitioner, dated on 12.06.2014, and 21.07.2022, and grant patta in favour of PALLATHALA AMMAN deity in respect of the property situated in Old Survey No.125, New Survey No.125/2, with an extent of 6 acres.

2. According to the petitioner, the subject property originally stood in the name of the deity, called Pallathala Amman, in 1927 settlement register. Subsequently, mutation had taken place in the names of third parties. In that situation, the petitioner filed a suit for declaration and consequential relief of possession against private parties, in whose names mutation had taken place. The said suit was decreed. The petitioner filed an appeal before the second respondent, seeking cancellation of revenue records standing in the names of private parties and restoration of revenue records in the name of petitioner's temple. The same has not been considered. Hence, the petitioner has come before this Court.

3. Government Advocate, who takes notice for the respondents, would submit that the appeal filed by the petitioner will be considered in accordance with law.

4. In view of the above, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the appeal filed by the petitioner, dated 21.07.2022, and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to petitioner, persons, in whose names revenue records stand as on today, and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 04.07.2025 NCC :
