PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to take the Arulmigu Pathala Kaliamman Temple, Perumal Kothanar Chavadi, Nethaji Road, Madurai and the Palabisheka Mandapam, Thirupparankunram under the control of the HR and CE Department within the time stipulated by this Court. ORDER

This writ petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and after dispensing with the requirement of filing of counter, as no adverse orders are proposed to be passed at this stage against any of the parties.

2.The petitioner appears to be a Trustee of Arulmigu Pathala kaliamman Thiruppani and Thiruparankunram Palabisheka Aarathanai Trust. The petitioner has alleged that the temple is under the management of persons belonging to two 2/6

communities living in Chunnambukara Street, Arisikkara Street, Inmaiyil Nanmai Tharuvar Kovil Street and in Vaniar 1st Street. 3.In para 7 of the affidavit, the petitioner has stated as follows: "7. I submit that during the year 2012, the management of the trust headed by Mr.Mani Kothanar opened a Bank account No. 476773659 in the Indian Bank, Town Hall Road, Madurai in the name of Perumal Kothanar Chavadi Trust. There was a balance of Rs.5,44,737/- in the said account."

4.It is submitted that the income of the temple is being swindled and the amounts are not being deposited into the bank account of the temple and that some of the ceremonies have also not been conducted. The petitioner has therefore given a representation to the respondents on 23.04.2024. 5.The learned Special Government Pleader for the official respondents would submit that the petitioner's representation will be considered and disposed of on merits.

6.Recording the above submission, there shall be a direction to the first respondent to pass suitable orders in response to the representation dated 23.04.2024 of the petitioner as expeditiously as possible, preferably within a period of 8 weeks from the date of receipt of a copy of this order after due notice to all, who are likely to be impacted by the orders to be passed by the first respondent.
