For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.51 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for

the alleged offence punishable under Section 379 of IPC, in Crime No.51 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons have stolen 66 numbers 12 mm iron wires. Hence, the complaint.

3. The learned Counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution, but, a false case has been foisted as against him. He further submitted that the co-accused was arrested and thereafter released on bail.

4. The Learned Government Advocate(Crl.Side)appearing for the respondent police submitted the three previous cases are pending against the petitioner. He further submitted that as per the confession statement of the co-accused/A1 the petitioner involved in the above said theft.

5. A perusal of CD file shows that with the help of the first accused, the petitioner stolen 66 numbers 12 mm iron wires.

6. Taking into consideration of the allegations and also considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
