PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the case in H.M.O.P.No.182 of 2021 on the file of the Principal Sub-Court,Trichirappali, and transfer the same to the learned Principal Sub-Court, Thanjavur. ORDER
The present transfer civil miscellaneous petition has been filed by the wife seeking to transfer H.M.O.P.No.182 of 2021 on the file of the Principal Sub-Court,Trichirappali to Principal Sub-Court, Thanjavur.
2. According to the learned counsel for the petitioner/wife, the wife is permanently residing at Thanjavur along with her parents. She finds it difficult to travel on every occasion to attend hearings in Principal Sub-Court,Trichirappali. The learned counsel appearing for the petitioner further submits that the wife has filed an application in D.V.C.No.12 of 2022 and the same is pending before the Additional Mahila Court, Thanjavur.
3. Considering the above said facts, H.M.O.P.No.182 of 2021 on the file of the Principal Sub-Court,Trichirappali is hereby withdrawn and transferred to Principal Sub-Court, Thanjavur. The learned Principal Subordinate Judge, Thanjavur is hereby directed to dispose of H.M.O.P.No.182 of 2021 as expeditiously as possible. 2/4
4. With the above said direction, this Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
