ORDER
The petitioners herein/A-1 & A-2, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 417, 420, 506(1) of IPC, in Crime No.41 of 2024, seek anticipatory bail.
2. The case of the prosecution is that the petitioners approached the defacto complainant and demanded money, stating that if the defacto complainant invested the money, she would receive double the amount in return. Believing their words, the defacto complainant deposited a total of Rs.1.70 crore. However, when the defacto complainant demanded the return of the invested amount, the petitioners threatened her with dire consequences. Hence, a case was registered.

The learned counsel for the petitioners submitted that the they are innocent persons and they have been falsely implicated in this case and based on the false allegations the present complaint was given. He further submitted that the petitioners are ready to deposit release deed. Hence, they prays anticipatory bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police strongly objected to grant anticipatory bail to the petitioners and submitted that totally nine previous cases are pending against the petitioners.
5. Eventhough, the petitioners are having nine previous cases considering the facts of the case, this Court is inclined to grant interim anticipatory bail to the petitioners.
6. Accordingly, the petitioners are directed to deposit the release deed before the respondent police. On such deposit, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate Court-I, Trichy, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Judicial Magistrate Court-I, Trichy, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:
(a) the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioners shall furnish his residential address and mobile number to the Judicial Magistrate Court-I, Trichy. (c) the petitioners shall appear before the respondent police daily at 10.30 a.m., without fail, until further orders; (d) the petitioners shall not tamper with evidence or witness either during investigation or trial;
(e) the petitioners shall not abscond either during investigation or trial;
(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the
petitioner in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and;
(g) if the accused/petitioners thereafter abscond, a fresh FIR can be registered under Section 269 of BNS, 2023.
