ORDER
The Criminal Miscellaneous Petition is filed to suspend the sentence of imprisonment imposed on the petitioner by the learned Judge, Special Court for trial of Prevention of Corruption Act cases, Tiruchirappli, in Special.Case.No.14/2011, dated 18.06.2025 and enlarge him on bail pending disposal of above appeal.
2. The learned counsel for the petitioner submitted that the petitioner has been 1/4
found guilty for the offences under Sections 7 and 13(2) r/w 13(1)(d) of Prevention of Corruption Act by the learned Trial Judge and he was convicted and sentenced to undergo one year imprisonment with fine of Rs.10,000/-(Rupees Ten Thousand only), in default to undergo six months of simple imprisonment for the offence under Section 7 of Prevention of Corruption Act; to undergo two years imprisonment with fine of Rs.10,000/-, in default to undergo six months of simple imprisonment for the offence under Section 13(2) r/w 13(1)(d) of Prevention of Corruption Act.
3. He further submitted that the Trial Court has itself suspended the sentence of imprisonment till 18.07.2025.
4. The learned Additional Public Prosecutor submitted that the prayer for suspension of sentence of imprisonment can be considered on conditions.

As there is no possibility of taking up the appeal within a short period and also taking into consideration of the fact that the sentence of imprisonment imposed against the petitioner has already been suspended by the Trial Court till 18.07.2025 and also the grounds made out to admit this appeal, I feel it is appropriate to 2/4
suspend the sentence of imprisonment alone on conditions. Accordingly, the substantive part of the sentence of imprisonment alone is suspended on the following conditions:
i. that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge, Special Court for trial of Prevention of Corruption Act Cases, Tiruchirappalli;
ii. that the petitioner shall appear before the said Court once in a month (i.e., on the first working day of every English Calender month) at 10.30 a.m. till the disposal of appeal.
