Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 3rd respondent to grant patta in the petitioner's name, based on the petitioner's representation, dated 02.12.2024.

ORDER

The petitioner herein seeks a direction to the third respondent to issue patta in his name, by considering his representation, dated 02.12.2024.

2. It is the case of the petitioner that the subject property originally belonged to his paternal aunt - Guruvammal and she executed an unregistered Will, dated 08.03.1996, bequeathing the subject property in his favour. Subsequently, she died in the year 2009. Based on the said unregistered Will, the petitioner submitted a representation before the respondents, seeking issuance of patta in his name. The same has not been considered. Hence, the petitioner has come before this Court.

3. Though the petitioner claims that Guruvammal died and he is the testamentary heir of the said Guruvammal, he has not produced any documents, such as, Death Certificate or Legal Heir Certificate of Guruvammal.

4. Under these circumstances, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the

representation submitted by the petitioner, dated 02.12.2024, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to petitioner and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 04.07.2025 NCC :
