ORDER

This writ petition has been filed seeking a direction to the 1st respondent to dispose the statutory appeal filed by the petitioner dated 17.11.2022 within the time limit as fixed by this Court.

2. Heard the learned counsel on either side and perused the materials placed before this Court.

3. The petitioner is presently working as 'Assistant Executive Officer', Tuticorin. The petitioner was imposed with the punishment of stoppage of increment for a period of two years with cumulative effect by the second respondent vide his order dated 25.10.2022 for his misconduct. Aggrieved by the same, the petitioner filed an appeal before the first respondent. Till date, the appeal has not been disposed of. Hence, the petitioner has filed the present Writ Petition.

4. Considering the limited relief sought for by the petitioner, this Court directs the first respondent to dispose of the appeal filed by the petitioner dated 17.11.2022 on merits and in accordance with law, after giving due opportunity to the petitioner, as well as any other persons, who may be 2/4

necessary in the subject matter, within a period of three months from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

5. With the above observations and directions, the Writ Petition stands disposed of. There shall be no order as to costs. 09.07.2025 NCC : Yes/No Index : Yes / No sm 3/4
