ORDER:- This Civil Revision Petition coming on for hearing on this day under the caption "Extension of time for Lower Court" and upon perusing the earlier order of this Court dated 27.07.2023, and direct the Court below to dispose of the petition in I.A.No.152 of 2016 in O.S.No.119 of 2009, within a period of one month, and the requisition letter submitted by the V Additional District Judge, Madurai vide in letter D.No.785/2023 dated 06.11.2023, this Court made the following order: This matter is listed today under the caption for 'extension of time'.

It is seen from the records that this Court vide order dated 27.07.2023, directed the learned V Additional District Judge, Madurai, to expedite the trial and dispose of the petition in I.A.No.152 of 2016 in O.S.No.119 of 2009 within a period of one month from the date of receipt of the Advocate Commissioner's report.

3. It is seen that the learned V Additional District Judge, Madurai has submitted a requisition, dated 06.11.2023 stating that the Commissioner has filed a memo that he will return the commissioner warrant, because of non-cooperation of the parties and he will visit the suit property on 25.11.2023 and file a report in the next hearing date; that the case was posted to 28.11.2023 and hence, seeks three months further time to dispose of the case.

4. In view of the above, the learned V Additional District Judge, Madurai, is hereby directed to instruct the Advocate Commissioner to file the report at an early date and to dispose of the case within a period of two months from the date of receipt of copy of this order.
